Biography

Ian McCauley is a director in Bayard’s litigation group and leads the firm’s eDiscovery practice. Ian focuses his practice on electronic discovery from the anticipation to the conclusion of litigation.

He has significant experience advising litigants in the Court of Chancery, Superior Court, District Court, and Bankruptcy Court on making defensible, efficient, and strategic decisions regarding the preservation, collection, and production of electronically stored information (ESI). He routinely consults with clients on document preservation and collection strategies; negotiates with opposing parties regarding the scope of document collection, review, and production; manages large-scale reviews of ESI for both internal investigative and litigation purposes; and argues discovery-related motions in the various Delaware courts.

Ian’s approach employs common sense solutions while emphasizing effective project management and leverage of emerging technology. His approach is designed to defensibly control the ever-growing costs associated with discovery while providing his clients with a strategic advantage in litigation. In addition to eDiscovery, Ian advises clients and co-counsel on litigation readiness, information governance, and data privacy issues.

Ian has developed repeatable but flexible best practices for the handling of all aspects of the Electronic Discovery Reference Model (EDRM). In addition to his work in litigation, Ian has served as eDiscovery liaison in Delaware Bankruptcy matters.
 

Ian frequently presents on eDiscovery topics and has been invited to speak at LegalTech New York, the Master’s Conference, meetings of various sections of the Delaware State Bar Association, Widener University Delaware Law School, and the Delaware Department of Justice.
