Bayard Attorneys Ericka Johnson and Steven Adler to speak at 2024 ABI Mid-Atlantic Bankruptcy Workshop
Wilmington, Delaware- On Tuesday, August 6, 2024, Bayard attorney Steven D. Adler is scheduled to speak on an American Bankruptcy Institute Workshop (ABI) panel titled “Financial Distress/Good Faith.” Steve will be joined by co-panelists Hon. Thomas M. Horan [U.S. Bankruptcy Court for the District of Delaware], K. Elizabeth Sieg [McGuireWoods LLP, Richmond, Va.], and Aaron H. Stulman [Potter Anderson & Corroon LLP, Wilmington, Del.]. They will discuss various topics including good-faith vs. bad-faith standards, the impact of the Third Circuit’s LTL opinions, and post LTL developments in other circuits. As a result, attendees will come away from the presentation better equipped to navigate the complexities of bankruptcy dismissals and understand the shifting legal landscape in this area.
Later in the day, workshop attendees can join a panel discussion titled: Creditor-on-Creditor Violence, Liability Management and Uptier Transactions featuring Bayard director Ericka Johnson. She will be joined by Hon. Michael B. Kaplan [U.S. Bankruptcy Court (D. N.J.)], Mark B. Joachim [Polsinelli, Washington, D.C.], and Robert B. Winning [M3-Partners, LP, New York]. The panelists will cover recent developments in liability-management transactions. Attendees will gain clarity on how these complex transactions are structured and executed.
