Bayard’s Bankruptcy Department provides services to debtors, official committees of unsecured creditors and equity holders, purchasers of assets, trustees, and lenders in bankruptcy cases. It also represents parties in other insolvency proceedings, including receiverships, assignments for the benefit of creditors, dissolution proceedings under state law and rehabilitations and liquidations of insurance companies. The Bankruptcy Department works regularly with clients through all phases of the reorganization or liquidation of troubled businesses, including out-of-court workouts.

The Bankruptcy Department represents clients in a number of jurisdictions, but focuses its practice primarily in bankruptcy cases in Delaware and New York. Over the last two decades, the Bankruptcy Department has participated in substantially all of the significant bankruptcy cases in Delaware. Recently, Bayard’s bankruptcy practice has expanded geographically to New York and southern New Jersey.

The Bankruptcy Department experienced an active and productive year representing debtors, statutory committees, dip lenders, indenture trustees, Chapter 7 trustees and post confirmation trusts and trustees. This past year, Bayard has worked as lead counsel, local counsel and conflicts counsel in the many bankruptcy cases filed in Delaware and in New York. The cases have involved debtors operating in a variety of business sectors including healthcare, auto parts, jewelry, newsprint, fast food and real estate.
